  CHAIRMAN MACKIE  called the Senate Community & Regional Affairs              
 Committee meeting to order at 1:35 p.m.

  REPRESENTATIVE KUBINA , prime sponsor of HB 212, explained the               
 legislation has been drafted to address a problem that occurs when            
 villages vote themselves dry.  Current law provides that when a               
 village votes to go dry, the perimeter of that village is a five-             
 mile radius from the center of the town.  This last year the                  
 village of Gulkana voted to go dry, and when the five-mile radius             
 was extended, it took in the village of Gakona.  HB 212 will give             
 the ABC Board some common sensibility to draw that line to where              
 the actual village boundaries do not take in neighboring villages             
 that have not voted to go dry.                                                
                                                                               
  CHAIRMAN MACKIE  asked if the legislation eliminates the five-mile           
 provision, or does it just allow the ABC Board to deviate from it             
 wherever they deem necessary.   REPRESENTATIVE KUBINA  responded that         
 the five-mile radius will stay in effect, but if it is an area                
 where it runs into another village or townsite, the board can use             
 their common sense in order draw a better line that does not take             
 in other places.                                                              
                                                                               
 There being no further testimony on HB 212 am,  CHAIRMAN MACKIE               
 asked for the pleasure of the committee.                                      
                                                                               
  SENATOR DONLEY  moved HB 212 am be passed out of committee with              
 individual recommendations.  Hearing no objection, it was so                  
 ordered.
